Separation from ServiceEmployees of the University of Dayton are employed with an “at will” status. Employees are not employed for any definite term and either party for any reason, with or without cause, may terminate the employment relationship at any time. Only the President of the University (or the board of trustees) has authority to enter into any agreement for employment for any specified period of time or to make any agreement contrary to the foregoing. VoluntaryA voluntary notice of separation from University service is to be in writing to the immediate supervisor with a copy to the office of human resources stating the last workday and reasonable notice is expected so that appropriate lead-time is available in order to obtain a replacement. The schedule below is to be followed in this regard. Exempt Positions - at least four working weeks notice prior to the date of separation from service. Nonexempt Positions - at least two working weeks notice prior to of the date of separation from service. A working week's notice means the actual days worked within the notice period. Vacation, sick leave and holidays are not considered as actual days worked. The last day actually worked is considered the last day of employment with the University of Dayton. Vacation may not be taken for the purpose of extending the term of employment. Any accrued vacation as of the last day worked will be paid in a lump sum in the last paycheck. Contact the office of human resources for additional information. InvoluntaryThe above notice is also to be given by the University where practicable in cases of involuntary separations. The University reserves the right to terminate employment with or without the above notice for the ordinary standard of failure to perform the job at an acceptable level, as well as for other reasons including, but not limited to, lack of work and personal misconduct. Payment during such notice period shall be only for services rendered or where otherwise agreed to in writing.
